Dover Conservation Commission Issues Enforcement Orders, ANRAD for Junction Street Development Site

DOVER — October 25, 2023 — Dover Conservation Commission approves ANRAD, enforcement orders, and COC in busy remote session. At the October 25 meeting, the five-member commission voted unanimously to issue an order of resource area delineation for the Junction Street property of PY Homes LLC, setting the bordering vegetated wetland boundary under the state Wetlands Protection Act and the town bylaw and an isolated vegetated wetland boundary under the bylaw only — a three-year delineation widely seen as a precursor to a potential Chapter 40B application. Commission wetland consultant Paul McManus of Ecotech said the revised plan incorporated all requested changes, though he cautioned that possible intermittent streams were "not something I am comfortable saying is not there," a question left open for any future notice of intent. The board also voted unanimously to issue two separate enforcement orders for clearing violations at 12 and 14 Miller Hill Road, requiring restoration and invasive-management plans within six weeks, and issued a notice of violation for unpermitted fill within the 50-foot no-disturb setback at 92 Haven Street. A disputed driveway-improvement application for 15 Wilsondale Street was continued pending town counsel guidance on whether a single easement holder may sign a notice of intent without the agreement of co-dominant-estate owners.
