Dover Conservation Commission Continues Pool Permit, Defers Tree-Clearing Enforcement Orders

DOVER — May 24, 2023 — Dover Conservation Commission defers enforcement orders in major wetland tree-clearing case while reappointing two members and approving a $6,438.75 agent payment. At the May 24 remote meeting, the commission heard from attorney Gregor McGregor, representing the Rollins family and Sudbury Valley Trustees, who said his clients already hold a preliminary $750,000 restoration proposal from firm Wilkinson and urged commissioners to immediately issue an enforcement order against 12 Miller Hill Road owner Francois Mallette, whose attorney Peter Brooks verbally accepted full responsibility for clearing on all three affected properties at the prior meeting. Commission Chair John Sullivan said he would consult town counsel before issuing orders, citing the need for written confirmation of culpability and a desire to avoid foreclosing legal options. The commission unanimously reappointed Sullivan and Tim Holler to three-year terms through 2026 and voted 6-0 to pay conservation agent Janet $6,438.75 in extraordinary April expenses. A pool and patio permit application at 36 Miller Hill Road was continued to the June 14 meeting after a revised site plan arrived too late for staff review.
