Dover Conservation Commission Approves Claybrook Pool, Weighs Fines for Chronic Violator

DOVER — July 9, 2025 — Dover Conservation Commission approves Claybrook pool project, eyes fines for long-running wetland violator. The commission voted unanimously four times on the 10 Claybrook Road application, approving waivers for a new pool fence within the 50-foot no-disturb setback and a retaining wall within the 70-foot setback, imposing $500 waiver fees on each, and granting a final permit with 11 special conditions including a saltwater-only requirement. Members declined to waive the fees, with one commissioner saying the pool "is not a replacement of a swimming pool that's suddenly become toxic." Separately, the commission scheduled a July 14 site visit to a Main Street farm where an owner identified as Brian deposited fill across an area roughly 50 feet wide and 400 feet long to a depth of about 3 feet near Trout Brook, a perennial stream within the commission's 200-foot jurisdiction. On enforcement, Chair John said he will contact town counsel to clarify how to formally impose and collect fines against the owner of 31 Springdale Road, where an $826.80 third-party review invoice has gone unpaid since January despite repeated contact from commission staff.
