Dover Planning Board Clears Path for Simple Majority MBTA Vote in September

DOVER — August 18, 2025 — Dover Planning Board unanimously clears the way for a simple majority MBTA zoning vote at a September 29 special town meeting. The board voted 4-0 on August 18 to designate the 9.57-acre Tisdale Drive/County Court condominium complex as an "eligible location" under state law — a procedural finding that allows the town's proposed MBTA Multifamily Overlay District bylaw to pass by simple majority rather than a two-thirds supermajority. Town Planner Melissa Sanuchi Rosie, six weeks on the job, told the assembled representatives of seven other boards that the overlay caps density at 16 units per acre, reducing the theoretical maximum from 227 to 159 units, and includes no affordability requirement. She warned that non-compliance risks more than $600,000 in annual Chapter 90 road funds and cited Marblehead as a town that has already had state earmarks revoked. Town counsel noted that a failed vote would not end the town's obligation: "The issue doesn't go away and the state law compliance requirement doesn't go away because the town votes it down." The planning board's mandatory public hearing on the zoning amendment is scheduled for September 8.
